Gardeners Lambeth Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Lambeth provides gardening and related services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means any individual, company, or organisation that requests or uses the services of Gardeners Lambeth.

Services means any gardening, garden maintenance, clearance, landscaping, soft landscaping, lawn care, hedge trimming, planting, or related work provided by Gardeners Lambeth.

Appointment means the agreed date and time when the Services will be carried out.

Agreement means the contract between Gardeners Lambeth and the Customer, comprising these Terms and Conditions and any written or verbal confirmation of a booking.

2. Scope of Services

Gardeners Lambeth provides a range of gardening and outdoor maintenance services within its service area, which includes Lambeth and selected surrounding districts. Availability may vary depending on location, access, and staffing.

The specific Services to be performed will be agreed with the Customer at the time of booking and confirmed in writing where applicable. Any description of Services, whether on our website, in promotional material, or provided verbally, is illustrative and does not form a binding specification unless expressly confirmed.

Gardeners Lambeth reserves the right to decline any job it reasonably considers unsafe, impractical, beyond the scope of normal gardening work, or outside the skills or equipment available.

3. Booking Process

Bookings may be made by the Customer through our online enquiry form or by other contact channels advertised by Gardeners Lambeth. A booking is not confirmed until Gardeners Lambeth has provided explicit confirmation of the Appointment and, where required, the Customer has accepted any quoted price.

The Customer is responsible for providing accurate information when requesting an Appointment, including property address, type of property, access information, parking arrangements, garden size, the nature of the work requested, and any known risks, hazards, or special requirements.

For certain Services, particularly larger projects or landscaping works, Gardeners Lambeth may provide a quotation following a site visit or request supporting information such as photographs and measurements. Quotations are generally valid for a limited period, which will be communicated to the Customer. Gardeners Lambeth is not obliged to honour quotations that have expired.

Where recurring or regular maintenance is requested, the frequency and day of service will be agreed in advance, but Gardeners Lambeth does not guarantee the same operative or exact time of day for each visit.

4. Access and Customer Responsibilities

The Customer must ensure that adequate access to the garden or outdoor area is available at the agreed Appointment time. This includes providing any keys, access codes, gate instructions, or informing any building management or concierge where necessary.

If Gardeners Lambeth operatives are unable to gain access or commence work for reasons within the Customer's control, this may be treated as a late cancellation and a call-out or cancellation fee may apply as set out in these Terms.

The Customer must ensure that the work area is reasonably clear of personal items, pet waste, and obstructions. Any known hazards, such as unstable structures, sharp objects, exposed wiring, ponds, or aggressive animals must be disclosed in advance. Gardeners Lambeth is not responsible for damage or delay caused by undisclosed hazards.

Children and pets must be kept away from the work area during the provision of Services for health and safety reasons.

5. Pricing and Quotations

Prices may be provided as hourly rates, fixed prices, or project-based quotations, depending on the type and scope of the Services. Gardeners Lambeth will indicate the pricing basis at the time of booking.

Where work is charged by the hour, a minimum call-out duration may apply. Any additional time beyond the minimum will usually be charged in rounded increments. Time spent unloading, setting up, tidying up, and loading equipment is included within the chargeable period.

Where a fixed-price quotation is provided, it will cover only the tasks specifically listed or reasonably inferred from the description at the time of quoting. Any changes requested by the Customer or additional work required due to unforeseen circumstances may result in an amended quotation or additional charges.

Gardeners Lambeth reserves the right to adjust prices to reflect changes in labour costs, disposal costs, material prices, or statutory charges. Any such changes will not affect confirmed quotations that are still within their validity period unless the scope of Services changes.

6. Payments and Invoicing

Payment terms will be communicated at the time of booking or quotation. Unless otherwise agreed, payment is due on completion of the Services for one-off jobs, and on or before the agreed date for regular maintenance contracts.

Gardeners Lambeth accepts various forms of payment as communicated directly to Customers. Cash payments may not be accepted for all types of work or at all times and may be refused at Gardeners Lambeth's discretion.

Invoices, where issued, will set out the Services provided, the charges, and any applicable taxes. The Customer must notify Gardeners Lambeth of any invoicing errors within a reasonable time, typically within seven days of receipt.

If payment is not received by the due date, Gardeners Lambeth reserves the right to charge reasonable late payment fees and interest in line with applicable UK legislation. Gardeners Lambeth may also suspend or cancel future Appointments or Services until outstanding balances are settled.

7. Deposits

For certain jobs, particularly larger works, landscaping projects, or where materials must be ordered in advance, Gardeners Lambeth may require a deposit before confirming the Appointment or commencing work. The amount and timing of the deposit will be notified to the Customer.

Deposits may be used to cover initial labour, materials, or administrative costs. In the event of cancellation by the Customer, deposits may be non-refundable or only partially refundable, depending on the timing of the cancellation and any costs already incurred by Gardeners Lambeth.

8. Cancellations and Rescheduling

The Customer may cancel or request to reschedule an Appointment by giving reasonable notice. Unless otherwise agreed, a minimum of 24 hours notice prior to the scheduled Appointment is required to avoid a cancellation charge.

If the Customer cancels or requests to reschedule with less than 24 hours notice, Gardeners Lambeth reserves the right to charge a cancellation fee, which may be up to the full estimated value of the first scheduled visit or a reasonable call-out fee, whichever is higher.

If Gardeners Lambeth needs to cancel or reschedule an Appointment due to staff illness, severe weather, operational issues, or other circumstances beyond its reasonable control, it will notify the Customer as soon as reasonably possible and offer an alternative date and time. Gardeners Lambeth is not liable for any indirect losses or costs caused by such changes.

Persistent last-minute cancellations or missed Appointments by the Customer may result in the withdrawal of service at Gardeners Lambeth's discretion.

9. Garden Waste and Environmental Regulations

Gardeners Lambeth complies with applicable UK waste and environmental regulations. The handling and disposal of green waste, soil, hard landscaping waste, and other materials will be agreed in advance with the Customer.

Unless expressly included in the quotation or booking, the Customer is responsible for the disposal of garden waste generated during the Services. Where waste removal is requested, additional charges will apply reflecting handling, transport, and disposal costs, including any statutory fees.

Certain types of waste, such as soil containing rubble, invasive plant species, or contaminated materials, may be subject to special handling rules or may not be collected at all. Gardeners Lambeth reserves the right to refuse removal of waste it reasonably believes is hazardous, not lawful to transport without a specific licence, or impractical to remove using standard equipment.

The Customer must not request or require Gardeners Lambeth to dispose of waste unlawfully, such as fly-tipping or burning in prohibited areas. Gardeners Lambeth operates in accordance with legal and environmental best practices and will not participate in any illegal activity.

10. Materials, Plants, and Guarantees

Where Gardeners Lambeth supplies materials, plants, turf, or other products as part of the Services, ownership of those items may pass to the Customer on full payment of the relevant invoice, unless otherwise specified.

While Gardeners Lambeth selects materials and plants with care, the long-term performance of living plants, lawns, and similar elements is influenced by factors beyond our control, including weather, soil conditions, pests, diseases, and aftercare by the Customer. For this reason, Gardeners Lambeth cannot guarantee the survival or ongoing condition of plants or lawns unless a specific written guarantee is provided.

Any manufacturer warranties on materials or equipment provided as part of the Services will be passed on to the Customer where legally and practically possible, subject to the terms of those warranties.

11. Health and Safety

Gardeners Lambeth takes health and safety seriously and aims to operate in line with relevant UK health and safety legislation and guidance. Our operatives are instructed to use appropriate tools, protective equipment, and safe working practices.

The Customer must co-operate with any reasonable health and safety instructions given by Gardeners Lambeth, including keeping people and pets away from areas where machinery is in use, avoiding contact with chemicals or treatments that have been applied, and observing any temporary barriers or warnings.

Gardeners Lambeth may refuse to carry out or may suspend work if it considers that conditions at the site create an unacceptable risk to its staff, the Customer, or the public. In such cases, Gardeners Lambeth will discuss alternatives with the Customer, and any wasted time or costs may be charged if the issue is within the Customer's control.

12. Liability and Limitations

Gardeners Lambeth will exercise reasonable care and skill when providing the Services. If damage is caused to property as a direct result of negligence by Gardeners Lambeth, the company will, at its discretion, either repair the damage, arrange for repair, or offer reasonable compensation.

Gardeners Lambeth is not liable for pre-existing damage or defects, wear and tear, or issues arising from incorrect information provided by the Customer. We are also not responsible for damage to underground cables, pipes, or other hidden services that have not been clearly identified by the Customer in advance.

To the fullest extent permitted by law, Gardeners Lambeth excludes liability for any indirect or consequential loss, including loss of profit, loss of enjoyment, loss of contracts, or loss of opportunity arising out of or in connection with the Services or these Terms.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under UK law.

13. Complaints and Service Issues

If the Customer is dissatisfied with any aspect of the Services, they should contact Gardeners Lambeth promptly, ideally within 48 hours of the work being carried out, explaining the nature of the issue and providing any relevant details.

Gardeners Lambeth will investigate complaints and, where appropriate, may arrange a revisit to inspect the work. If a fault or shortcoming in the Services is identified, Gardeners Lambeth may, at its discretion, rectify the issue, offer a partial refund, or take other reasonable steps to resolve the matter.

Failure to raise concerns within a reasonable time may affect Gardeners Lambeth's ability to investigate or address the issue, particularly where plants or lawns have grown or changed, or where third parties have carried out further work.

14. Force Majeure

Gardeners Lambeth is not liable for any delay or failure to perform any of its obligations where such delay or failure is due to events or circumstances beyond its reasonable control. This may include, but is not limited to, extreme weather, flooding, storms, fire, strikes, lockouts, industrial disputes, acts of government, or acts of God.

In such cases, Gardeners Lambeth will make reasonable efforts to notify the Customer and to resume Services as soon as it is reasonably practicable to do so.

15. Data Protection and Privacy

Gardeners Lambeth collects and processes personal data such as names, addresses, and contact details for the purpose of managing bookings, delivering Services, and handling payments and enquiries. Personal data is handled in accordance with applicable UK data protection laws.

Customer information will not be sold to third parties. Data may be shared with trusted service providers for operational purposes, such as payment processing or waste disposal, but only to the extent necessary to perform the Services.

16. Amendments to these Terms

Gardeners Lambeth may update or amend these Terms and Conditions from time to time. The latest version will apply to new bookings and will be made available on request. Where changes materially affect existing ongoing contracts, reasonable notice will be given to affected Customers.

17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of Services by Gardeners Lambeth, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Services, whether contractual or non-contractual.

By booking or using the Services of Gardeners Lambeth, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
